Hvad skal en overensstemmelseserklæring indeholde?

En erklæring skal indeholde produktidentifikation, producentoplysninger, relevant lovgivning, materialetyper og eventuel lagdeling, brugsbetingelser, referencer til tests og analyser samt navn, dato og underskrift fra ansvarlig person.

What is a Declaration of Compliance?

It is a legal document that confirms that products or materials intended to come into contact with food comply with relevant legislation, including Regulation (EC) No. 1935/2004 and (EU) No. 10/2011 for plastics. In Denmark, a DoC is required for B2B sales for all materials, while in other EU countries the requirement basically only applies to plastics. Without a correct declaration, the products cannot be legally sold.

Which products require a Declaration of Compliance?

The declaration applies to all materials, including: plastic, paper, glass, ceramics, metals, silicone, rubber, wood, laminates, adhesives, composites and paints/coatings.

If the product – in whole or in part – comes into direct or indirect contact with food, e.g. packaging, utensils or production equipment, a valid declaration must be available.

What should the declaration contain?

A declaration of Compliance (DoC) must document that the material complies with applicable EU and national regulations, and must contain:

Identification of the material or object (name, type, batch, etc.)
Company name and address and manufacturer/importer, if applicable
Date of the declaration
Confirmation of compliance with applicable regulations: EU 10/2011 for plastics and 1935/2004 for all materials as well as relevant national or industry requirements
Information on restricted substances, migration or NIAS, purity criteria and use (time, temperature, food type, area/volume), if applicable
Confirmation of functional barriers, reprocessing batch or recycled substances, if applicable
Name, date and signature of responsible person

The declaration must always be up-to-date and can be presented upon inspection. Lack of documentation may lead to withdrawal and sanctions.
